Terms and Conditions
   
Definitions

In these conditions the following words shall have the following meanings applied to them:

"The Company" means Bourgogne Stone Ltd.

"The Buyer" means the person, firm or company who places an order with the company for the supply of goods.

"The Goods" means the products or materials supplied by the Company.

"The Quotation" means the communication addressed to the Buyer whereby the company sets out the details of the basis on which it is prepared to do business.

Quotation

The Quotation is valid for 90 days from the date thereon. A contract will only be formed when the Buyer's payment has been received and acknowledged by the Company, and an Order Acknowledgement issued.

Payment A deposit of 50% is required to action an order. The balance is due 14 days before shipment can commence to the Buyer. Title to all goods will remain with the Company until payment in full is made.
VAT All prices are nett and exclude VAT, which will be chargeable at the rate current at date of invoice.
Delivery Periods Delivery periods are given in good faith and the Company will endeavour to comply with the periods detailed in the Quotation.
The Company reserves the right to alter the periods if necessary due to the following causes:
a) Force Majeure
b) Adverse weather conditions that affect material availability or delivery of finished goods.
c) Civil commotion, strike or lock out affecting the manufacture or delivery of finished goods.
d) The Company's inability for reasons beyond it's control and which it could not reasonably have foreseen at the date of the Quotation or acceptance of order to secure such labour and material as are essential to meet the delivery of finished goods.
e) The inability to obtain materials from suppliers. The Company excludes any financial or other liability for the inability to meet delivery periods by reason of the provisions of this clause. Failure to deliver within the delivery period will not constitute grounds for terminating the contract unless agreed in writing by both parties.

Upon Delivery Please check all materials ordered upon arrival or as soon as practically possible. Any claim for breakages or defective goods must be notified with full details, by telephone or fax and confirmed in writing within 3 days of receipt of goods.
  Stone, Timber and Terracotta are natural materials. These should be installed by mixing all the materials within a consignment to ensure the blending of any colour, knots or vein variation. No claim is permissible once the Goods have been installed.
Furthermore the Company does not accept responsibility or liability for installation, sealing or refinishing of any product. The final quantities ordered are the responsibility of the Buyer or their tiling contractor.
Stone, Timber and Terracotta are supplied subject to the following qualifications:
a) As these are natural materials they will incorporate natural flaws, fissures, knots and the like. Such features will not be a cause for their rejection.
b) Where samples of materials are provided they can only be regarded as indicative of the material that will be supplied.
There will always be variations in colour, pattern and veining and such variations will not be cause for rejection.
c) The Company’s judgement in respect of the suitability of the material will be final.

Cancellations On all custom orders which include antique stone, mosaic, ceramics, bespoke timber panels and any other non-stock material no returns or cancellations are accepted. On standard items where unforeseen circumstances mean there is a need to cancel the order, provided it is cancelled within 14 days of the original order placement an administration charge of 25% of the total order value is charged. After this period no cancellations will be accepted.
